SECEX initiates sunset review regarding the imports of disposable syringes from China and rubber tubing from Germany, United Arab Emirates and Italy Author: Caroline Dias


The Brazilian Secretariat of Foreign Trade (“SECEX”) initiated today two new investigations regarding the international trade of goods.


SECEX Notice No. 39 initiates the sunset review regarding the imports of disposable syringes from China. The product is commonly classified under items 9018.31.11 e 9018.31.19 of the Mercosur Common Nomenclature – NCM (HS based). The petitioner is the Becton Dickinson Indústrias Cirúrgicas Ltda.


For purposes of the initiation, the Brazilian authority constructed the normal value based on information of the Chinese production, resulting a internalized CIF normal value of 44,821.86 R$/ton. The absolute and relative difference between the normal value and the domestic industry average price was not made available. But the authority considered that the difference between the normal value of the imported goods and the domestic industry price indicated that, for the producers/exporters to be part of the Brazilian market, they would need to sell the goods on an inferior price than the normal value and, in this sense, resume the dumping practices.


The applied duties are partially suspended, until September 30, 2020, for public interest reasons, in relation to the imports of plastic disposable syringes for general use, with a capacity of 1ml, 3ml, 5ml, 10ml or 20ml, with or without needles. The suspension was applied in order to facilitate the measures related to the Covid-19 pandemic.


The deadline for submitting the foreign producer/exporter questionnaire and the importer questionnaire is July 27, 2020. Identified parties can request the deadline to be postponed up to 30 additional days. Other parties interested in the investigation shall file a request for qualification in the proceeding by July 12, 2020.

SECEX also initiated today the sunset review regarding the imports of rubber tubing from Germany, United Arab Emirates and Italy, by SECEX Notice No. 40. The product is commonly classified under item 4009.11.00 of the Mercosur Common Nomenclature – NCM (HS based). The petitioner is the company Armacell do Brasil Ltda.


For all origins, the authority considered that the difference between the normal value of the imported goods, on internalized CIF condition, and the domestic industry price, on ex works condition, indicated that, for the producers/exporters to be part of the Brazilian market, they would need to sell the goods on an inferior price than the normal value and, in this sense, resume the dumping practices. The absolute and relative differences between the normal values and the domestic industry average price was not made available.
